{"id":127129,"date":"2025-04-14T10:22:01","date_gmt":"2025-04-14T10:22:01","guid":{"rendered":"http:\/\/cryptospotters.net\/?p=127129"},"modified":"2025-04-14T10:22:01","modified_gmt":"2025-04-14T10:22:01","slug":"google-to-enforce-mica-rules-for-crypto-ads-in-europe-starting-april-23","status":"publish","type":"post","link":"http:\/\/cryptospotters.net\/?p=127129","title":{"rendered":"Google to enforce MiCA rules for crypto ads in Europe starting April 23"},"content":{"rendered":"<p>Source: Cointelegraph.com NewsGoogle will begin enforcing stricter advertising policies for cryptocurrency services in Europe under the Markets in Crypto-Assets (MiCA) framework, the company said in a recent policy update.The move could be a \u201cdouble-edged sword\u201d for regulation that may prevent initial coin offering (ICO) frauds, but risks further enforcement gaps, according to legal advisers.<br \/>\nStarting April 23, cryptocurrency exchanges and crypto wallet advertising in Europe must be licensed under Europe\u2019s MiCA framework or under the Crypto Asset Service Provider (CASP) regulation.<br \/>\nCrypto advertisers on Google will also have to comply with \u201clocal legal requirements,\u201d including \u201cnational-level restrictions or requirements beyond MiCA\u201d and be \u201ccertified by Google,\u201d according to a March 24 Google policy announcement.<br \/>\nThe new advertising policy will apply to most European countries, including Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxemburg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain and Sweden.<br \/>\nPolicy violations \u201cwon\u2019t lead to immediate account suspensions,\u201d as a warning will be issued at least seven days before any account suspensions, added Google\u2019s policy update.<br \/>\nThe policy shift follows the implementation of the MiCA framework in December 2024, which introduced the first comprehensive regulatory structure for digital assets across the European Union.<br \/>\nRelated: EU MiCA rules pose \u2018systemic\u2019 banking risks for stablecoins \u2014 Tether CEO<br \/>\nGoogle\u2019s policy seen as double-edged sword<br \/>\nGoogle\u2019s new crypto advertising requirements present a \u201cdouble-edged sword\u201d for crypto regulation, according to Hon Ng, chief legal officer at Bitget.<br \/>\n\u201cOn one hand, they do enhance investor protection by filtering out unregulated actors,\u201d he told Cointelegraph.<br \/>\n\u201cThe MiCA framework\u2019s strict AML\/CFT and transparency requirements create a safer ecosystem, reducing scams like the ICO frauds that plagued the industry pre-2023,\u201d he said.<br \/>\nHowever, Ng warned the policy could be \u201coverly restrictive\u201d without flexible implementation, especially since transition periods for national licensing vary across jurisdictions.<br \/>\nSince Google\u2019s transition period for national licenses varies by country, this may create \u201ctemporary gaps in enforcement,\u201d and even bigger challenges around compliance costs, Ng said, adding:<br \/>\n\u201cSmaller exchanges may struggle with MiCA\u2019s capital requirements (15,000\u2013150,000 euros) or the bureaucratic hurdle of dual certification (both Google and local regulators). These measures are a net positive for trust but need flexibility to avoid stifling innovation.\u201d<br \/>\nRelated: Most EU banks fail to meet rising crypto investor demand \u2014 Survey<br \/>\nOther industry watchers don\u2019t see this as a fundamental change for Google or investor protection.<br \/>\nThe updates may be more oriented toward \u201cprotecting Google from liability than protecting the investors themselves,\u201d according to Mattan Erder, general counsel at layer-3 decentralized blockchain network Orbs.<br \/>\n\u201cAny impact of this change in Google\u2019s policy is downstream of the regulations themselves.
