{"id":80860,"date":"2023-03-30T22:17:59","date_gmt":"2023-03-30T22:17:59","guid":{"rendered":"http:\/\/cryptospotters.net\/?p=80860"},"modified":"2023-03-30T22:17:59","modified_gmt":"2023-03-30T22:17:59","slug":"trump-indicted-in-porn-star-hush-money-payment-case","status":"publish","type":"post","link":"http:\/\/cryptospotters.net\/?p=80860","title":{"rendered":"Trump indicted in porn star hush money payment case"},"content":{"rendered":"<p>Source: Politics<\/p>\n<p>NEW YORK \u2014 A New York grand jury indicted former President Donald Trump Thursday for his alleged role in a scheme to pay hush money to a porn actress during the 2016 presidential campaign, according to two people familiar with the matter.<\/p>\n<p>The indictment, voted on by the grand jury Thursday afternoon and filed under seal according to the individuals, thrusts the country onto uncharted and uncertain legal and political ground.<\/p>\n<p>The case against Trump, brought by the Manhattan District Attorney\u2019s Office, is centered on a $130,000 payment to an adult film actress, Stormy Daniels, who claimed she <a href=\"https:\/\/www.politico.com\/story\/2018\/05\/24\/stormy-daniels-hush-money-lawsuit-607599\" target=\"_blank\" rel=\"noopener\">had an affair<\/a> with Trump. Trump has denied the affair. He is the first former president to ever be criminally charged.<\/p>\n<p>Trump has already tried to use the charges to rally his base, calling on his followers to protest and \u201ctake back our nation.\u201d But there\u2019s no precedent for a presidential candidate campaigning during his own criminal trial. And while the case could stretch beyond November 2024, a conviction before then would spark a host of constitutional issues.<\/p>\n<p>Trump\u2019s indictment follows <a href=\"https:\/\/www.politico.com\/news\/2022\/12\/06\/trump-org-guilty-on-all-counts-in-new-york-criminal-tax-fraud-trial-00072609\" target=\"_blank\" rel=\"noopener\">the unrelated December conviction<\/a> of his family business \u2014 the Trump Organization \u2014 for tax fraud in a case also prosecuted by Alvin Bragg, the Manhattan district attorney.<\/p>\n<p>The indictment of Trump stems from the 2018 federal conviction of his former lawyer Michael Cohen, <a href=\"https:\/\/www.politico.com\/story\/2018\/08\/21\/michael-cohen-strikes-plea-deal-with-prosecutors-790646\" target=\"_blank\" rel=\"noopener\">who pleaded guilty<\/a> to campaign finance violations for facilitating the payment to Daniels. That payment came during the heart of the 2016 presidential campaign. And both Cohen and federal prosecutors have said that he acted \u201cin coordination with and at the direction of\u201d the former president.<\/p>\n<p>The Trump Organization later reimbursed Cohen for the payment to Daniels, prosecutors said in court filings. The company\u2019s executives authorized $420,000 in payments to Cohen in an effort to cover his original payment and tax liabilities, and to reward him with a bonus, according to prosecutors. The Trump Organization falsely <a href=\"https:\/\/www.justice.gov\/usao-sdny\/press-release\/file\/1088966\/download\" target=\"_blank\" rel=\"noopener\">recorded those payments<\/a> in their books as legal expenses, prosecutors said.<\/p>\n<p>Federal prosecutors in the Manhattan U.S. attorney\u2019s office subsequently pursued a criminal inquiry into whether those payments violated campaign-finance law, but they later ended the probe <a href=\"https:\/\/www.politico.com\/story\/2019\/07\/17\/trump-hush-money-payments-probe-over-1418074\" target=\"_blank\" rel=\"noopener\">without bringing charges<\/a>.<\/p>\n<p>The company\u2019s former chief financial officer, Allen H. Weisselberg, who was given immunity by federal prosecutors in their investigation of the hush money that led to the charges against Cohen, <a href=\"https:\/\/www.politico.com\/news\/2023\/01\/10\/trump-org-weisselberg-sentenced-tax-fraud-00077285\" target=\"_blank\" rel=\"noopener\">pleaded guilty<\/a> to an unrelated tax fraud scheme in August 2022.<\/p>\n<p>Cohen testified before the grand jury in the Manhattan district attorney\u2019s investigation of Trump. It\u2019s unclear if Weisselberg, who is now serving a five-month jail sentence, was also called as a witness.<\/p>\n<p>Though the Manhattan district attorney\u2019s office offered Trump the opportunity to testify before the grand jury prior to his indictment, he declined to do so.<\/p>\n<p>The indictment is sure to cloud Trump\u2019s 2024 presidential campaign and triggers a number of unprecedented scenarios. If Trump pleads not guilty and the case goes to trial, a process that can take many months, he could face the possibility of campaigning for the White House while undergoing a criminal trial. And if he were to win a second term while facing or serving a prison sentence, that would give rise to a host of constitutional issues.<\/p>\n<p>Trump has said an indictment would not stop him from campaigning for another term. When asked if he would stay in the 2024 race if formally charged, Trump told reporters at <a href=\"https:\/\/www.politico.com\/news\/2023\/03\/04\/donald-trump-cpac-maga-00085525\" target=\"_blank\" rel=\"noopener\">CPAC in March<\/a>, \u201cOh absolutely. I wouldn\u2019t even think about leaving.\u201d He has said his supporters are \u201cvery upset\u201d about the multiple investigations he\u2019s facing, and added he thinks the probes will \u201cenhance\u201d his poll numbers.<\/p>\n<p>Throughout his presidency and in his post-White House life, Trump has cast himself as a victim of partisan \u201cwitch hunt\u201d investigations targeting him and his business dealings. His fellow Republicans have largely echoed that claim, though it remains to be seen whether those running for the party\u2019s presidential nomination will rally to Trump\u2019s side or cast him off.<\/p>\n<p>At least one potential 2024 Republican rival, former Arkansas Gov. Asa Hutchinson, has said that Trump should <a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2023\/03\/11\/trump-quit-2024-race-indicted-hutchinson\/11452360002\/\" target=\"_blank\" rel=\"noopener\">end his campaign<\/a> if charged.<\/p>\n<p>The former president is also facing potential criminal charges on three other fronts \u2014 for allegedly attempting to undermine the 2020 election results in Georgia, taking classified documents from the White House (and obstructing efforts to recover them) and for his involvement in the Jan. 6, 2021, attack on the U.S. Capitol.<\/p>\n<p>The New York case against Trump are the outgrowth of years of investigation. Bragg inherited the Trump case from his predecessor, Cy Vance, and both district attorneys initially indicated there wasn\u2019t enough evidence to bring a case against the former president.<\/p>\n<p>Bragg, however, stressed that his investigation remained ongoing even amid the departure of two longtime prosecutors who led the probe and publicly alleged that Bragg <a href=\"https:\/\/www.politico.com\/newsletters\/new-york-playbook\/2023\/02\/08\/pomerantz-v-bragg-world-00081781\" target=\"_blank\" rel=\"noopener\">had cold feet<\/a>when it came to charging Trump.
